Slovenia: why confirm a former employee's job?

Every Slovenian employer must, at the worker's request, issue a confirmation of the kind of work done when the employment ends. Confirming the same facts takes a minute and helps the person into their next job. certo asks on their behalf, with their explicit consent.

Law as of 26 October 2026 · Zakon o delovnih razmerjih (ZDR-1), Uradni list RS, št. 21/13 with amendments up to 70/25, unofficial consolidated text NPB 14 on PISRS

In short

  • The facts are already on paper. When the employment ends, the employer must, at the worker's request, issue a confirmation of the kind of work they did, and it may say nothing that would make it harder to find a new job (Article 78). That is the fact we ask about; the dates come from the same personnel records.
  • It helps the person who worked for you. A record confirmed by a former employer is what the next employer trusts. Answering takes about a minute and needs no account.
  • certo asks on their behalf, with their explicit consent. The GDPR lets an employer disclose personal data with the consent of the person it concerns (Art. 6(1)(a)), and the Employment Relationships Act allows a worker's data to go to third parties in connection with the employment relationship (Article 48(1)). The person started this check themselves, for these facts and no others.
  • You do not have to answer. No Slovenian law obliges an employer to answer certo. Declining is fine.

The Employment Relationships Act

Zakon o delovnih razmerjih (ZDR-1). Quoted from the consolidated text on PISRS, the state's legal information system. PISRS marks it as unofficial (neuradno prečiščeno besedilo); the binding text is the Act and its amendments as published in Uradni list RS.

Article 78: the confirmation of the kind of work

In English: when the employment contract ends, the employer must, at the worker's request, return all their documents and give them a confirmation of the kind of work they did; the confirmation must say nothing that would make it harder for the worker to find a new job. certo asks for that kind of fact and nothing that could harm the person.

Article 48(1): when a worker's data may go to third parties

In English: workers' personal data may be collected, processed, used and passed to third parties only where this or another law provides for it, or where it is needed to exercise rights and obligations arising from, or in connection with, the employment relationship. Article 48(4) applies the same to job applicants. The Article does not mention consent. We read a confirmation that the person asked for, of facts you certify anyway, as given in connection with the employment relationship, with the person's consent under the GDPR as the legal basis. If your organisation reads Article 48 more strictly, decline.

Article 28(2): what is never asked

An employer must not ask a job applicant about family or marital status, pregnancy, family planning or other data not directly connected with the employment relationship. certo never asks you about any of these.

Personal data

The GDPR applies directly in Slovenia; the Personal Data Protection Act (ZVOP-2) supplements it.

  • Art. 6(1)(a), consent. The legal basis for your answer.
  • Art. 7(1), proof of consent. certo records which account asked, when, and for which facts. Write to support@certo.bio and we send you the record for your request.
  • Art. 5(1)(c), data minimisation. You confirm or leave unticked only the facts listed. Add nothing else: anything beyond them is not covered by the person's consent.

What this means for your answer

  • Tick only what your HR, payroll or personnel records show.
  • Not sure it is the same person? Press "We can't find a matching record". Never confirm a record you are not sure is theirs.
  • Your policy is not to answer? Press "We do not answer these requests". The record shows your organisation declined, and nobody else there is asked.
