Romania: why confirm a former employee's job?
Every Romanian employer must attest the work a former employee did and how long it lasted on request, and the Labour Code lets a new employer ask a former one about exactly these facts. Confirming them takes a minute and helps the person into their next job. certo asks on their behalf, with their explicit consent.
Law as of 26 October 2026 · Codul muncii (Law No. 53/2003, republished), consolidated form of 27 April 2026
In short
- The facts are already on paper. At the request of an employee or a former employee, every employer must issue a document attesting the work done and how long it lasted (art. 34(5)). Those are the facts we ask about, never the salary.
- It is the check Romanian hiring already makes. The Labour Code lets a new employer ask a job applicant's former employers about the activities performed and the length of employment, and nothing else (art. 29(4)). Confirming the same facts to certo is the same check, done once and online.
- It helps the person who worked for you. A record confirmed by a former employer is what the next employer trusts. Answering takes about a minute and needs no account.
- certo asks on their behalf, with their explicit consent. The GDPR lets an employer disclose personal data with the consent of the person it concerns (Art. 6(1)(a)). The person started this check themselves, for these facts and no others.
- You do not have to answer. No Romanian law obliges an employer to answer certo. Declining is fine.

In English: an employer may ask a job applicant's former employers for information about them, but only about the activities performed and the length of employment, and only after informing the person concerned. certo asks about the same two things, and here the person concerned is the one who asked.
Art. 34(5): the document every employer issues on request
La solicitarea salariatului sau a unui fost salariat, angajatorul este obligat să elibereze un document care să ateste activitatea desfășurată de acesta, durata activității, salariul, vechimea în muncă, în meserie și în specialitate.
In English: at the request of an employee or a former employee, the employer must issue a document attesting the work they did, its duration, the salary and their length of service. certo asks only about the work and its duration, never the salary, so your records already hold the answer.
Art. 40(2)(i): employees' data stay confidential
să asigure confidențialitatea datelor cu caracter personal ale salariaților.
In English: the employer must ensure the confidentiality of employees' personal data. That is why you confirm only the facts the person chose, to certo, and nothing else.
Art. 29(3) and art. 27(4): what is never asked
Information an employer asks of a job applicant may serve only to assess their ability to do the job and their professional aptitudes (art. 29(3)), and asking for a pregnancy test at hiring is forbidden (art. 27(4)). certo never asks you about pay, health, family, beliefs, a criminal record or anything else beyond the facts listed.
