Luxembourg: why confirm a former employee's job?

Every Luxembourg employer must give a departing employee who asks a certificate of employment stating the dates they started and left and the nature of the job. Confirming the same facts takes a minute and helps the person into their next job. certo asks on their behalf, with their explicit consent.

Law as of 26 October 2026 · Code du travail, consolidated version of 26 July 2026 (Legilux)

In short

  • The facts are already on paper. When the employment contract ends, the employer must give an employee who asks a certificate containing only the dates of employment and the nature of the job (Code du travail, Art. L. 125-6). Those are exactly the facts we ask about, and nothing else.
  • It helps the person who worked for you. A record confirmed by a former employer is what the next employer trusts. Answering takes about a minute and needs no account.
  • certo asks on their behalf, with their explicit consent. The GDPR makes the person's consent a legal basis for passing on their data (Art. 6(1)(a)). The person started this check themselves, for these facts and no others.
  • You do not have to answer. No Luxembourg law obliges an employer to answer certo. Declining is fine.

The Labour Code

Code du travail, quoted from the official consolidated text on Legilux.

Art. L. 125-6: the certificate of employment

In English: when the employment contract ends, the employer must give an employee who asks for it a certificate containing only the date they started and the date they left, the nature of the job held or, where relevant, of the jobs held one after another and the periods in which each was held. No biased or unfavourable remark about the employee may appear on the certificate.

These are exactly the facts we ask about, the dates and the job title, so your records already hold them. The law keeps the certificate to these facts alone, and so does certo: you tick a listed fact or leave it, and add nothing.

What is never asked

We found no provision of the Code du travail that lists the questions an employer may not put to a job applicant. Its Articles L. 241-1 and L. 251-1 prohibit discrimination, among other grounds on sex, religion or belief, disability, age, sexual orientation, nationality, race or ethnic origin. certo never asks you about any of these, nor about health, family, pay, performance, the reason for leaving or a criminal record.

Personal data

The GDPR applies directly in Luxembourg; the Act of 1 August 2018 on the organisation of the National Data Protection Commission and the implementation of the GDPR supplements it.

  • Art. 6(1)(a), consent. The legal basis for your answer.
  • Art. 7(1), proof of consent. certo records which account asked, when, and for which facts. Write to support@certo.bio and we send you the record for your request.
  • Art. 5(1)(c), data minimisation. You confirm or leave unticked only the facts listed. Add nothing else: anything beyond them is not covered by the person's consent.

What this means for your answer

  • Tick only what your HR, payroll or personnel records show.
  • Not sure it is the same person? Press "We can't find a matching record". Never confirm a record you are not sure is theirs.
  • Your policy is not to answer? Press "We do not answer these requests". The record shows your organisation declined, and nobody else there is asked.
