Bulgaria: why confirm a former employee's job?

Every Bulgarian employer already enters the dates of employment and the position held in the single electronic employment record, and a later employer is entitled to see them. Confirming the same facts takes a minute and helps the person into their next job. certo asks on their behalf, with their explicit consent.

Law as of 26 October 2026 · Кодекс на труда (Labour Code), Articles 347a and 349 as amended by the Act published in State Gazette No. 85 of 2023, in force from 1 June 2025

In short

  • The facts are already on record. The dates of employment and the position held are what every employer enters in the single electronic employment record (Labour Code, art. 349(1)). Those are the facts we ask about.
  • It is the check Bulgarian hiring already makes. A later employer is entitled to the information previous employers entered, pay excluded (art. 347a(4)). Confirming the same facts to certo is the same check, done once and online.
  • It helps the person who worked for you. A record confirmed by a former employer is what the next employer trusts. Answering takes about a minute and needs no account.
  • certo asks on their behalf, with their explicit consent. The GDPR lets an employer disclose personal data with the consent of the person it concerns (Art. 6(1)(a)). The person started this check themselves, for these facts and no others.
  • You do not have to answer. No Bulgarian law obliges an employer to answer certo. Declining is fine.

The Labour Code

Кодекс на труда, the Labour Code. Since 1 June 2025 the paper employment record book (трудова книжка) has been replaced by a single electronic employment record kept in the employment register. Quoted from the official text of the amending Act as adopted by the National Assembly on 26 September 2023 and published in State Gazette No. 85 of 2023.

Art. 349(1): what the electronic employment record holds

Единният електронен трудов запис съдържа данни за: … 5. датата на сключване на трудовия договор и началото на неговото изпълнение; … 8. датата и основанието за прекратяване на трудовото правоотношение; … 10. кода на заеманата длъжност по Националната класификация на професиите и длъжностите;

In English: the single electronic employment record contains, among other data, the date the employment contract was concluded and work began, the date and ground of termination, and the code of the position held under the National Classification of Occupations and Positions. These are the facts we ask about, so your records already hold them.

Art. 347a(4): a later employer already sees them

In English: employers are entitled to the information entered by previous employers about the workers they hire, as set out in the ordinance under art. 62(5), except the pay and compensation the worker received from previous employers. certo asks about the same kind of facts and never about pay.

§ 22 of the amending Act: the old employment record book

Трудовата книжка, издадена преди влизането в сила на този закон, е официален удостоверителен документ за вписаните в нея обстоятелства, свързани с трудовата дейност на работника или служителя.

In English: an employment record book issued before the Act came into force remains an official certifying document for the circumstances entered in it about the person's work. For employment before June 2025 the same facts are in that book.

Art. 128a: documents on request

The Labour Code also obliges an employer, at an employee's written request, to issue within 14 days the documents certifying facts connected with the employment relationship (art. 128a(1)). We found no provision of the Labour Code that limits what an employer may tell a third party about a former employee; that question is answered by the GDPR, below.

What is never asked

certo never asks you about pay, performance, the reason for leaving, health, family, beliefs or a criminal record, or anything else beyond the facts listed.

Personal data

The GDPR applies directly in Bulgaria; the Personal Data Protection Act (Закон за защита на личните данни) supplements it.

  • Art. 6(1)(a), consent. The legal basis for your answer.
